The term Eve-teasing is ued to refer to sexual harrassment or molestation of women by men in public places such as streets, public transportation, park and many places of social meetings. Eve-teasing in public places has been a perennial problem. Recently, incidents of eve-teasing leading to serious injuries to and even death of a woman have been reported. Such act of eve-teasing, apart from dehumanising act, is an unlawful intrusion on the right of privacy and sanctity of a female. It is a serious blow to her supreme honour and offends her self-esteem and dignity. It humiliates the victim and is capable of leaVing a traumatic effect on or behind her.
Women are often criticised for 'inviting' molesters by way of their seductive way of dress and make-up. But this theory collapses in the face of rustic, illiterate and poor village women who cannot afford to dress seductively. The roots of such acts lies in the patriarchy as from childhood, parents bring up their sons and daughters by two completely different rules of censorship on their movements . The harmful effects of eve-teasing have yet another aspect. When opposed by the victims themselves or defended against by their family members from such harrassments, many times the eve-teasers show a tendency to take a revenge. This gives rise to other severe crimes such as acid attacks or beating or killing of family members or even the heinous crime of raping the girls. There have been many incidences and records of such cases.
It becomes important to focus on the reasons for such a heinious crime. Many psychologists believe that sex, love or fun is not the only motive that men indulge in this behaviour. Eve-teasing is closely related to the patriarchal mindset of male. Men are raised to believe that they are more powerful than women both physically and emotionally. They feel that they are doing nothing wrong. Women on the other hand are made to feel vulnerable and the weaker sex. Teachers of psychology and social scientists believe eve-teasing to be a result of the frustrations suffered by a majority of youth. Disappointed by the unbecoming attitude of teachers and indifferent parents, they yearn for an outlet to vent their aggression and depression. Many who do not inherit good values tend to indulge in acts of sexual harrassment as well. Eve-teasing is a euphemism, a conduct which attracts penal action but it is seen, only in one state, a statue has been enacted i.e. Tamil Nadu. Eve-teasing
:led to the death of a girl named Sarika Shah from Chennai in 1998, which led the government bringing an ordinance, namely, the 'Tamil Nadu Prohibition of Eve-teasing Ordinance, 1998', which later became an act, namely the 'Tamil Nadu Prohibition of Eve-teasing Act, 1998'.
The objective of the act was to prohibit eve-teasing in any place in the state of Tamil Nadu. Even though the term 'Eve-teasing' doesn't find place in the Indian Penal Code there are other provisions which broadly cover offences comprising sexually colored remarks. These are:
- Section 354 of !PC punishes offences involving force intended to outrage the 'modesty' of a woman.
- Section 509 of !PC punishes verbal insults, sounds and gestures that are sexually-coloured and are intended to harass a woman .
- There are many other punishments for the offenders of eve-teasing under the Sections 292 and 294 of the IPC.
- Criminal Law (Amendment) Act, 2013 brought Section 354A to protect women against sexual harassment.
- Vishakha v/s State of Rajasthan case led to the formulation of the Sexual Harrassment of Women at Workplace (prevention) Act in 2013.
The public opinion have changed undoubtedly towards eve-teasing and laws have been formed to curb the problem . The introduction of separate ladies compartments in local trains and metros in major cities and separate buses for women is other such initiatives. Yet, the problem has not been sorted out. There is a need to increase public awareness and raise our voice against such heinious crime. It requires an extensive public education aimed at every section of society at large. Strict punishment for the wrong Joers can be a good deterrent. Every man needs to be aware of 'how to treat a woman and have respect for her dignity'.
